Term of Service for Surface Evolution LLC

1. Acceptance of Terms By accessing and using the services of Surface Evolution LLC ("we," "us," or "our"), you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services.
2. Mobile Messaging Service (SMS/MMS) Terms By consenting to Surface Evolution’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Surface Evolution through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, appointment reminders). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Surface Evolution. Your participation in this program is completely voluntary.
- Cost: Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
- Frequency: Message frequency varies.
- Opt-Out: You may opt-out of the Service at any time. Text the single keyword command STOP to the number from which you received the message or reply STOP to any text message you receive from us. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you.
- Help: For Service support or assistance, text HELP to the number from which you received the message or email us at info@surface-evolution.com.
- Carriers: Carriers are not liable for delayed or undelivered messages.
3. Privacy Policy We respect your privacy. Use of the Service and any personally identifiable information submitted through the Service is governed by our Privacy Policy. We will not share or sell your mobile information to third parties or affiliates for marketing or promotional purposes.
4. Intellectual Property All custom designs, sample boards, and installation techniques demonstrated by Surface Evolution remain the intellectual property of Surface Evolution until the project is paid in full.
5. Limitation of Liability To the fullest extent permitted by applicable law, in no event will Surface Evolution be liable for any indirect, consequential, exemplary, incidental, or punitive damages arising from or relating to your use of the services.
6. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of Iowa, without giving effect to any principles of conflicts of law.
7. Age Restriction You must be at least 18 years of age to use this Website or our Services. By accessing or using the Website, you represent and warrant that you are at least 18 years old.
